Dont' Take The Money and Run - Injury Settlements
You've been injured because someone was careless, you looked for a lawyer in the yellow pages, and one ad in particular caught your eye. "Quick settlements! Maximum cash for your injury!" You signed up with the 'quick settlement' attorney, you brought a lawsuit, and now your lawyer tells you you've been offered money to settle your case. What do you do?Don't take the money and run. What do you do?
Veteran New York injury attorney Gerry Oginski cautions victims. "A quick settlement is not always in a victim's best interests. Insurance companies know there are many law firms out there simply looking to settle a case quickly and are not willing to go all the way to trial to protect your interests."
"Many insurance companies will offer a small settlement in the hopes that the injured victim is eager to get some money for their injuries," says Gerry Oginski. "Don't fall for this trick."
Here are some tips found on Attorney Oginski's website that's been described as a news junkie haven for consumers, www.oginski-law.com.
(1) Dont' choose a New York injury lawyer simply because he (or she) tells you they can get you a 'quick settlement'. If they do make such a claim, ask them to put it in writing. They won't do it. In a medical malpractice case, you rarely ever see quick settlements because those cases are hotly contested and take years to resolve.
(2) If you bring a lawsuit, don't expect that your 'quick settlement' will be sufficient to compensate you for your injuries, your lawyer's expenses, and the legal fee.
(3) If your lawyer recommends the insurance company's offer, ask why. Why isn't your case worth more than what's being offered?
(4) Never take the insurance company's first offer. It's almost always their 'low-ball' offer.
(5) You must talk to your lawyer and ask for his legal advice about similar cases; your risk of losing at trial; the potential you could get more than what's being offered; the potential for further negotiation as your case gets closer to trial.
