Yaz Lawsuit Settlements Reach $142 Million

Los Angeles, CA, April 27, 2012 – Nadrich & Cohen, LLP reports that German drug-maker Bayer AG has settled approximately 651 Yaz side effects lawsuits totaling $142 million. Earlier this month, it was reported that the drug-maker had reached settlements in approximately 500 cases filed by women who claimed that they suffered serious complications after using Yaz birth control pills.

According to a Bloomberg report, the settlements average out to approximately $218,000 per plaintiff and more settlements are expected to be forthcoming. Prior to Bayer’s latest announcement, JPMorgan Chase & Co. analyst Richard Vosser said that the Yaz lawsuit settlements may end up costing Bayer an estimated $2.65 billion. Yaz is believed to be linked to numerous reports of serious complications, including deep vein thrombosis, pulmonary embolism, heart attack and stroke.

News of additional settlements in the Yaz side effects litigation comes just after the U.S. Food and Drug Administration announced it would require Bayer to issue updated warning labels for Yaz, Yasmin and several other oral contraceptives made by the company. Specifically, the new warning labels will advise women that using birth control pills containing a synthetic hormone known as drospirenone, the primary ingredient in Yaz, may result in a threefold risk of experiencing a serious blood clot.

An FDA advisory panel was convened in December 2011 following the publication of an FDA-funded research study in 2011 which indicated that women who used Yaz may be up to 74% more likely to experience a blood clot compared to women who used older types of birth control pills. While the panel eventually voted 15-11 to allow the continued sale of Yaz, its members agreed that stronger warning labels for the drug were necessary.

Currently, there are thousands of Yaz lawsuits still pending against Bayer in the U.S. A number of these lawsuits have been consolidated into a federal multidistrict litigation (MDL), which is being heard in an Illinois court. The first trials in the Yaz litigation were scheduled to begin in January, but the judge presiding over the cases ordered both sides to mediation instead. Bellwether trials are set to begin at the end of this month if the mediation talks prove ineffective.
