Dusseldorf Table 2024 – Rising Maintenance Claims - MTR Legal

The Dusseldorf Table 2024 has been released and comes into effect on January 1, 2024. The updated Dusseldorf Table shows an increase in the maintenance claims of children.

The Dusseldorf Table is a universally acknowledged guideline for determining children's maintenance claims following the separation or divorce of their parents. It significantly focuses on the parents' living conditions and the child's age, clarifies MTR Legal Attorneys, who provide consultation, among other areas, in family law.

The Dusseldorf Table has been published by the Higher Regional Court of Dusseldorf since 1979 and aids courts in calculating maintenance claims. However, it is not binding.

Minimum maintenance increases from January 1, 2024

According to the Dusseldorf Table 2024, the minimum maintenance for both minors and adults has once again risen.

Following the updated Dusseldorf Table, as of January 1, 2024, the maintenance claim for children up to the completion of their 6th year of life will rise by 43 Euros to 480 Euros. Children up until the completion of their 12th year of life are entitled to 551 Euros—an increase of 49 Euros. From the 13th year of life until reaching adulthood, the claim arises by 57 Euros to 645 Euros. For adults, the requirement increases to 689 Euros.

Income levels raised

These are the requirement rates for the first income group, which now caps at 2,100 Euros of income. The other income levels have each been increased by 200 Euros too.

Due to the rise of requirement rates in the first income group, the maintenance claims in the other income groups have also increased. Up until the fifth income group (up to 3,700 Euros), they are raised by five percent and then by eight percent thereafter.

The requirement rate for studying children who don't live with their parents remains the same. It continues to stand at 930 Euros but can be higher under certain circumstances.

Child benefits are anticipated to remain at 250 Euros per child in 2024 and will be deducted from the requirement.

Self-maintenance also increases

Not only do children's maintenance claims rise from January 1, 2024, but so does the self-maintenance of the obligated parents. The self-maintenance for a non-earning obligated party rises from previously 1,120 Euros to 1,200 Euros. If the obligated individual is gainfully employed, it increases from 1,370 to 1,450 Euros.
