PRESS RELEASE:

CONSTITUTIONAL & ETHICS EXPERT MARVIN MORALES
COMMENTARY ON DECISION OVERTURNING ROE V. WADE

FOR IMMEDIATE RELEASE

JUNE 24, 2022

(SAN ANTONIO, TX) MARVIN MORALES, Constitutional Law & Legal Ethics expert and licensed Texas lawyer comments and shares his opinions and expertise on today's decision to overturn Roe v. Wade by the U.S. Supreme Court:

"Do you remember playing MONOPOLY as a child? What strikes me most is how every household had their own unique rules. (Ours was a side pot of money collected on the Free Parking.) Now recall all the fights ensued at your friend's house because of said rule changes; especially those sprung at the last second. Today, the Supreme Court changed the federal jurisprudence system and has effectively decided to stop paying $200 for players passing Go."

"I share no opinion on the subject of abortion, but rather only wish to highlight the effects today's decision renders on the practice of law."
"Our legal system is based on the practical notion called stare decisis whereby we respect and weigh greater past legal precedents in resolving new legal issues. It could be argued the ethical duty of all jurists is to preserve legal precedents for the common good until such time as the law imposes no substantial burden on the community. In other words, the burden of changing any law rests on the person seeking the change."
"In my opinion, today's decision in Dobbs v. Jackson announces the end to stare decisis and upends our entire legal system and traditions- to include fifty years of arguably history's greatest Justices upholding Roe v. Wade's legal precedent. Indeed, as Justice Sonia Sotomayor's dissent points out, there's no discernible reason to overrule Roe other than the change in the Court's composition. Consequently, lawyers and all jurist no longer can rely on past legal precedent or stare decisis because the better indicator of how the Supreme Court will rule is based on the personal politics and beliefs of each individual Justices."
"Here in Texas we elect our Judges and inevitably politics permeates in all their decisions. Of course, should we grow tired of said judge we simply vote them out. No such luck with a Supreme Court Justice. Without course change we can expect a future where the rules of the game are constantly changing; where liberty & justice are reserved for the few."
