Colorado Springs Jury Acquits Shooting Suspect

A Colorado Springs jury has acquitted a suspect in an August 27, 2016 shooting. The shooting occurred at a rental home in eastern Colorado Springs during a house party attended by 75-100 people. According to witness testimony, the victim was located in the living room of the home, when she was randomly struck by gunfire. Further testimony revealed that the suspect was on the second floor of the home handling a shotgun, when the firearm discharged through the floor, directly above the living room. The sound of the gunfire caused other individuals to discharge weapons and in total, testimony revealed that at least 10 shots were fired from various weapons. The victim suffered serious bodily injury, requiring emergency surgery at Memorial Hospital, however, medical staff failed to preserve the projectile removed from her abdomen. The victim was highly intoxicated when she arrived in the emergency department, causing a delay in staff finding the gunshot wound. During trial, defense attorney Steven Rodemer, successfully argued that there was no evidence the suspect discharged the firearm, and that even if the suspect did, there was no evidence to find that the victim was struck by a projectile from the shotgun. The suspect faced between 5-16 years in prison.
